Terms and Conditions of Use

These terms and conditions of use (“Terms”) govern your use of the US Trade Mark Registrars website and any other products or services offered by US Trade Mark Registrars (collectively, the “Service”). By using the Service, you agree to be bound by these Terms, as well as any other terms, guidelines, or rules that may be applicable to specific features of the Service.

Your misuse of the Trademarks displayed on the service, or any other content on the service, except as provided in these Terms, is strictly prohibited.

3. Prohibited Uses

You may use the service only for lawful purposes and in accordance with these Terms. You agree not to use the service:

In any way that violates any applicable federal, state, local, or international law or regulation.
To transmit, or procure the sending of, any advertising or promotional material, including any “junk mail,” “chain letter,” “spam,” or any other similar solicitation.
To impersonate or attempt to impersonate US Trade Mark Registrars, a US Trade Mark Registrars employee, another user, or any other person or entity.
To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the service, or which, as determined by US Trade Mark Registrars, may harm US Trade Mark Registrars or users of the Service or expose them to liability.

4. Disclaimer of Warranties

The service and all content, products, and services included in or available through the service are provided “as is” and without warranties of any kind. To the fullest extent permitted by law, US Trade Mark Registrars disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. US Trade Mark Registrars does not warrant that the service or any content, products, or services included in or available through the service will be uninterrupted or error-free, that defects will be corrected, or that the service or the server that makes the service available is free of viruses or other harmful components.

5. Limitation of Liability

In no event shall US Trade Mark Registrars be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from or in connection with the use or inability to use the service or any content, products, or services included in or available through the service. In no event shall US Trade Mark Registrars’s total liability to you for all damages, losses, and causes of action (whether in contract, tort (including, but not limited to, negligence), or otherwise) arising from or relating to these terms or your use of the service exceed the amount.

6. User-Generated Content

You may have the opportunity to submit or post content, including but not limited to comments, reviews, and suggestions, on the Service (“User-Generated Content”). You understand and agree that US Trade Mark Registrars has no obligation to review or monitor User-Generated Content but reserves the right to remove or edit any User-Generated Content at its sole discretion. By submitting or posting User-Generated Content, you represent and warrant that you have all necessary rights and permissions to do so, and that your User-Generated Content does not violate any third-party rights or applicable laws.

7. Termination

US Trade Mark Registrars may terminate or suspend your access to all or part of the Service, with or without notice, for any reason, including, without limitation, a breach of these Terms. Upon termination, all licenses and rights granted to you in these Terms will immediately terminate, and you must immediately cease all use of the Service.

8. Governing Law and Dispute Resolution

These Terms and any disputes arising from or relating to these Terms or the service shall be governed by and construed in accordance with the laws of the USA, without giving effect to any choice or conflict of law provision or rule. Any legal suit, action, or proceeding arising out of or relating to these Terms or the service shall be instituted exclusively in the federal courts of the United States, and each party irrevocably submits to the jurisdiction of such courts in any such suit, action, or proceeding. The prevailing party in any such suit, action, or proceeding shall be entitled to recover its reasonable attorneys’ fees and costs.
